Eric A. Ristau
Eric A. Ristau is a shareholder of Eustice, Laffey, Sebranek & Auby, S.C. (“ELSA”), and a partner in DeMarb Brophy LLC. Eric practices with both ELSA and DeMarb Brophy LLC. His practice primarily focuses on four areas: creditors’ rights and collections, business law, estate planning, and real estate.
In the area of creditors’ rights and collections, he works closely with businesses and financial institutions to protect their ability to collect the monies they are owed. He has drafted numerous workout and forbearance agreements in efforts to avoid litigation and, when a workout is not possible, represents his clients in court proceedings. Once judgment is obtained, Eric is well-versed in the remedies available to creditors, including lien laws and wage and non-earnings garnishments. He also represents creditors in federal bankruptcy court proceedings.
In addition, in the area of business law, Eric works with closely-held businesses on all facets of general business matters, from the formation, purchase, merger or sale of the business, to contract drafting, and advising on employment issues. When litigation occurs or is necessary, Eric has the experience to successfully represent his business clients in negotiations, trials, and appeals, as well as alternative dispute resolution proceedings such as mediation and arbitration.
In the area of estate planning, Eric works closely with individual clients and families to ensure that their wishes are clearly addressed using a variety of estate planning techniques.
Eric also assists individuals and businesses in the purchase or sale of residential or commercial real estate. As counsel for a seller, he recently helped transition ownership of a large family farm to the next generation.
